Olisto provides its services through the Olisto mobile application that connects users’ smart devices by the usage of the Triggs.
1. Applicability
In order to be able to use Olisto’s services, you must:
- be at least sixteen (16) years old and able to enter into contracts;
- complete the registration process;
- agree to the Terms of Service and Privacy Policy; and
- provide true, complete, and up-to-date information about yourself.
By using Olisto, you represent and warrant that you meet all the requirements listed above and that you won’t use Olisto in a way that violates any laws or regulations. (Representing and warranting is like making a legally enforceable promise.)
2. Definitions
“Account” – password protected profile created by the User in the Olisto App.
“Olisto” – Olisto B.V. a limited liability company located at Entrada 100, Amsterdam-Duivendrecht, the Netherlands and providing services under the Olisto brand.
“App” – the Olisto application which is available for Android and iOS devices, in which Users create their Accounts, connect channels to their Accounts, and subsequently create/save and enable Triggs.
“Website” – Olisto platform for providing customer support, source of information on how to use Olisto services, and a marketing channel.
“Services” – the use of the Olisto App and Website, any and all other advantages as described on the Website, the App, or through any authorized third party.
“Trigg” – specific use case in the App, which is made available through the use of the Channels. A Trigg always consists of one or multiple conditions and one or multiple actions.
“Bundle” – specific use case in the App which consists of multiple Triggs.
“Channel” – connection you may establish within the Olisto App to the service of a third party or a service enabled by Olisto itself. A channel provides conditions and/or actions, which can be used in a Trigg.
“Users” – consumers of Olisto Services that create their Accounts in the Olisto App
“Partners” – third-party companies that Olisto creates partnerships/integrations which allow Olisto users to make use of the Services.
3. Olisto Account and Registration
By creating an Olisto Account, you agree to:
- provide and maintain true, accurate, current, and complete information about yourself;
- not allow your Olisto Account to be used by anyone else to access the Service;
- not use the name of another person with the intent to impersonate that person or in a way that otherwise causes confusion as to the origin of your Account.
4. Account and password
It is your responsibility to keep your Account name and password confidential. You’ll immediately notify us of any unauthorized use of your accounts. We’re not responsible for any losses due to stolen or hacked passwords. We don’t have access to your current password, so we may only reset your password if you request to do so in the App.
5. Quality of service and our performance
To be able to create and provide a complete service for Olisto Users to connect their devices and apps, and having them work together, following users’ rules (Triggs) Olisto depends on connections to our external Partners. Olisto is not responsible for the correct working of the services provided by the Partners. These Partners may change technical specifications on their side, or their terms under which we use the connections. They may suspend connections with Olisto Channels, or the connections (or services) may suffer from faults or problems in those Channels APIs. And as a result, we may discontinue the support of certain external Channels and associated Triggs, even without notice.
We do make the best technical efforts to keep the Olisto service running reliably. However, we cannot accept responsibility or liability for outages on our services. Our Service may experience an outage due to a failure, or for instance due to maintenance work carried out on our servers and infrastructure.
Should our service have problems, amongst others for reasons mentioned above, Triggs may be not be implemented, implemented with a delay, or executed repeatedly. We cannot rule this out. By using the App you accept that this may happen. Therefore, Users are strongly advised not to use the Olisto App for connections or Triggs which can cause danger or harm if they are not executed correctly. Also, Users are advised to not use Olisto for any critical use cases in their work or private life.
We therefore provide Olisto “as is”, without any warranty. We therefore do not warrant that our service is free from errors, bugs, interruptions or inaccuracies. Under no circumstance will we be liable to you for any damage (direct, indirect or consequential) for any amount.
6. Service Use. Legal age
Prior to creating the Account the User confirms that he/she is at least 16 years old and has the capacity to be bound by these Terms of Service.
7. Content and Use Policy
The Olisto App and the Website can only be used for lawful purposes.
The Users agree not to:
- publish, post, distribute, or propagate discrediting, obscene, unlawful material or information.
- send any unsolicited or unauthorized spam, advertising messages, promotional materials, and junk mail.
- threaten, abuse, disrupt or otherwise violate the rights, including privacy rights of others.
- otherwise engage in illegal or unlawful activities through the Services, Website, or the App.
8. Privacy
The Users agree to the terms and conditions and Olisto’s Privacy Policy as published on the Website.
9. Social media and third-party platforms
The Olisto Service includes functionality that allows you to access and post content to Social Media and third-parties platforms by sharing your Triggs with your friends and family.
By connecting your Olisto Account with your account on a third-party platform like Facebook, you grant us permission to access and use the information that you make available through your Facebook account and that Facebook has made available to Olisto, in accordance with the privacy or other settings that are applicable to your Facebook account.
When you share or post your Trigg to a Social Media or third-party platform through the App, you agree to comply with all terms of use, policies and guidelines established by the applicable Social Media or third-party platform with regard to the Trigg you post. You also agree to be solely responsible and liable for any claims arising as a result of sharing your Triggs to any Social Media or third-party platform.
10. Termination
You may terminate your Olisto Account at any time by using the account termination option in the App. If you terminate your Olisto Account you will not be able to access the Services.
Olisto may refuse Services, close accounts of any Users, and change eligibility requirements at any time if it receives information that the Account has been used in a way that breaches Olisto’s Terms of Services and Privacy Policy.
11. Miscellaneous
Olisto reserves the right, at any time, to alter these general terms and conditions. If there is a material change to the general terms and conditions, Olisto may notify the Users in advance either through email, notice on the Website or by of any other reasonable method. If the User does not agree to the modified version of the general terms and conditions, the User must terminate his or her account and stop using the App and associated Services.
12. Intellectual Property
Unless otherwise stated, all rights to the Website and the App and any information there, including but not limited to databases, patents, copyrights and other intellectual property rights, are owned by Olisto.
The User is permitted to read the Olisto website and the information on it and make copies or shares for their own personal use, for example by printing or storing it. All other use of the Olisto Website and the App, for example the storage or reproduction of (a part of) the Olisto App without the express written consent of Olisto
As far as the User is permitted to interact with the App, the User grants to Olisto any intellectual property rights that are created by the posting, uploading or interaction with the App.
